This Privacy Policy explains how we collect, use, disclose, and protect information about you when you visit our Site, use our Apps, or contact us about our services.
By using the Site or our Apps, you agree to the collection and use of information in accordance with this policy. If you do not agree with any part of this policy, please discontinue use of the Site and Apps.
Short version: We collect only what we need to provide our services and app features — including using a trusted third-party AI service to generate appraisals when you use The Appraisal Room. We do not sell your personal information. Ever.

We collect information in three ways: information you provide directly to us, information collected automatically when you use our Site, and information collected through your use of our Apps — including photos you choose to submit for AI-powered features such as those in The Appraisal Room.

How We Use Your Information
We use the information we collect for the following purposes:
- Responding to inquiries — To reply to messages submitted through our contact form or sent directly to our email.
- Providing services — To scope, quote, and deliver web design and development services you request.
- AI-powered appraisals — To analyze photos you submit through The Appraisal Room (using our third-party AI service provider) and generate the estimated valuation you requested. See Our Apps & AI Features below for details.
- Improving the Site — To analyze how visitors use our Site so we can improve performance, content, and usability.
- Improving our Apps — To analyze app usage and crash data so we can fix bugs and improve features.
- Communicating with you — To send project updates, follow-ups, and relevant service information you have requested.
- Legal compliance — To comply with applicable laws, regulations, and legal processes.
- Fraud prevention & security — To detect and prevent fraudulent activity or unauthorized access to the Site or Apps.
We will not use your information for any purpose materially different from those described above without first obtaining your consent.

Our Apps & AI-Powered Features
Some of our mobile applications use artificial intelligence to power core features. This section explains how that works, what we collect to make it possible, and how that data is shared. It applies in addition to the general practices described elsewhere in this policy.
The Appraisal Room
The Appraisal Room lets you photograph an item to receive an estimated valuation. When you use this feature:
- You choose what to submit. A photo is only captured or uploaded when you actively use the appraisal feature. The app requests camera and/or photo library permission on your device for this purpose; you can deny or revoke this permission at any time in your device's settings.
- Your photo is sent to a third-party AI provider. To generate an appraisal, the photo and any accompanying details you provide are transmitted over an encrypted connection to Anthropic, a third-party artificial intelligence service, for analysis. Anthropic processes the image to identify the item and produce the descriptive and valuation output the app displays to you.
- We use the output only to deliver your appraisal. We do not use submitted photos for advertising, profiling, or any purpose unrelated to generating the appraisal you requested.
- Equivalent protection. Our AI service provider is contractually and technically required to protect your data with safeguards equivalent to those described in this policy, and does not use data submitted through our app to train its models outside the terms of our agreement with them.
By taking or uploading a photo using the appraisal feature, you consent to that photo being transmitted to our AI service provider for the purpose described above. If you do not wish to do this, simply don't use that feature of the app.
Looking for the specifics on a different app? As we release new apps or add AI-powered features to existing ones, we will update this section to describe their data practices before — or at the same time as — those features become available.

Our Site may use cookies and similar tracking technologies to enhance your experience and gather analytics data. Cookies are small text files stored on your device by your browser.

- Service Providers — Trusted third-party vendors who assist us in operating the Site or delivering services (e.g., email hosting, analytics platforms, project management tools). These parties are contractually obligated to use your data only as directed by us and in accordance with this policy.
- AI Service Providers — When you use AI-powered features in our Apps, such as photo-based appraisals in The Appraisal Room, the relevant photo and request data is shared with Anthropic, our third-party AI processing partner, solely to generate the output you requested. This provider is contractually required to protect your data with safeguards equivalent to those described in this policy.
- Legal Requirements — If required by law, court order, or government authority, or to protect the rights, property, or safety of Five Suns Digital LLC, our clients, or others.
- Business Transfers — In connection with a merger, acquisition, or sale of assets, your information may be transferred to a successor entity. We will notify you before your data is subject to a different privacy policy.
- With Your Consent — For any other purpose with your explicit consent.

Data Retention
We retain personal information only for as long as necessary to fulfill the purposes described in this policy, or as required by law. Specifically:
- Contact form submissions are retained for up to 3 years from the date of receipt, or until the conclusion of any related business relationship.
- Project-related communications are retained for the duration of the project plus 5 years for business record-keeping purposes.
- Analytics data is retained in accordance with the data retention settings of the applicable analytics platform (e.g., Google Analytics default is 26 months).
- Photos submitted for AI-powered features are retained only as long as necessary to generate and deliver the requested output (such as an appraisal), after which they are deleted from our active systems.
When data is no longer needed, we will securely delete or anonymize it.

Your Privacy Rights
Depending on your location, you may have the following rights regarding your personal information:
- Access — Request a copy of the personal information we hold about you.
- Correction — Request that we correct inaccurate or incomplete information.
- Deletion — Request that we delete your personal information, subject to legal retention requirements.
- Portability — Request that we provide your data in a structured, machine-readable format.
- App Permissions — Grant or revoke camera, photo library, and other app permissions at any time through your device's operating system settings.
- Opt-Out of Marketing — Unsubscribe from any marketing or promotional communications at any time by contacting us or using the unsubscribe link in any email we send.
- Withdraw Consent — Where processing is based on consent, you may withdraw that consent at any time.

Five Suns Digital LLC is headquartered in Colorado. Under the Colorado Privacy Act (CPA), Colorado residents have additional rights, including the right to:

- Opt out of profiling in furtherance of decisions that produce legal or similarly significant effects
- Access, correct, delete, and obtain a portable copy of your personal data
- Appeal a denial of any of the above rights

Our Site is operated from the United States. Children's Privacy

In the event of a data breach that affects your rights and freedoms, we will notify you as required by applicable law.
